Webinar: Litigating Preemption Claims after Douglas v. ILC
The National Senior Citizens Law Center is presenting a webinar, entitled Litigating Preemption Claims after Douglas v. ILC, on March 5, 2012 at 1:00 pm Eastern.
The Douglas v. ILC case raised the important issue of whether preemption under the Supremacy Clause of the US Constitution can be utilized to bring a claim that a state law conflicts with federal Medicaid law. The Supreme Court has remanded the case for consideration of recent events which give rise to a claim under the Administrative Procedure Act, but four dissenters asserted that no claim should be allowed.
Hear a panel discussion of strategies for litigating preemption claims in Medicaid, immigration, and other safety-net and civil rights cases in light of the February 22nd decision.
