Birthright Citizenship and Trump v. Barbara (Webinar)

The Pennsylvania Legal Aid Network Asian Pacific American Affinity Group is hosting a virtual presentation via Zoom entitled Birthright Citizenship and Trump v. Barbara on May 4, 2026 from 12:00 PM-1:00 PM Eastern.

On April 1, 2026, the Supreme Court heard oral argument in Trump v. Barbara. The Barbara class action challenges Executive Order No. 14160, which, if enforced, would take away citizenship from children born in the U.S. if neither parent is a U.S. citizen or lawful permanent resident. The executive order is currently enjoined. The Court is expected to issue a decision by the end of June.

At stake is over 128 years of legal precedent. The question of whether children born in the U.S. to foreign-born parents are citizens was addressed in U.S. v. Wong Kim Ark

Panelist Rahat N. Babar, Deputy Executive Director and General Counsel of the National Asian Pacific American Bar Association (NAPABA), filed an amicus brief in Barbara recounting the historical significance of Wong Kim Ark and the detrimental impact the executive order would have on the Asian American community. 

Panelist Kimberly W. Leung, Staff Attorney at the Asian Law Caucus, is a member of the litigation team representing the Barbara plaintiffs.

Rahat and Kimberly will provide a historical overview of birthright citizenship, outline the context, procedural history, and arguments presented in Barbara, and discuss the implications of the potential outcomes.
