HCBS Personal Assistance Services Reductions and Appeals


Community Legal Service and PA Health Law Project logosPlease join the PA Health Law Project (PHLP) and Community Legal Services (CLS) for the second installment in their Home and Community Based Services (HCBS) training series for legal advocates on Friday, March 8, 2024 from 1:00 PM-2:30 PM Eastern.;

Attorneys from PHLP and CLS will cover common issues around personal assistance services (PAS).   They will cover how medically necessary services are defined in the Community HealthChoices (CHC) context, and how to appeal PAS hours reductions and denials of requests for an increase in PAS hours. 

Topics to be covered include: 

  • What is PAS?
  • How PAS hours are determined
  • Appeal framework
  • Reviewing key MCO records [interRAI, PSST, PCSP, etc.]
  • Preparing evidence in support of Participant’s appeal
  • Trigger events
  • Potential arguments and strategies for appeals
  • Considerations in settling appeals.  

CLE Credit

This program has been approved by the Pennsylvania Continuing Legal Education Board for 1.5 hours of substantive law, practice and procedure CLE credit.
